The world’s largest prescription drug company, Merck & Co. has agreed to pay $10 billion to settle a lawsuit alleging that it illegally marketed and sold prescription medicines for unapproved uses.
The agreement, which was announced Tuesday, is expected to result in a majority of the company’s revenue from the products it sells under the brand name of Viagra.
Merck sold the drugs to the U. S. Food and Drug Administration in 2010 under the brand name of Pfizer Inc., which is based in Puerto Rico. It was the second company to sell the drugs.
Under the agreement, Merck was to be eligible for a settlement of any liability it might have caused under the label of the drug. In addition, the company would be required to pay $10 million in penalties and restitution to the victims.
“We believe the allegations in the complaint may be serious enough to allow us to make these settlements,” said Michael A. St. Joseph, senior vice president and general counsel for Merck, who represented the company in its lawsuits.
The lawsuit alleges that Merck failed to adequately warn users about the potential side effects and drug interactions of prescription medicines used to treat erectile dysfunction.
The suit also alleges that the company knew or should have known of its medicines’ risks, including the potential for dangerous side effects or the potential for serious side effects.
According to the suit, Pfizer’s drug labels, including its “Viagra,” included warnings about the possible effects of certain heart-related issues, including cardiac arrest.
Pfizer Inc. said Monday that it had entered into a settlement agreement with the plaintiffs’ attorneys in a $10 million case.
Pfizer paid $10 million to settle the claims and the company agreed to pay the victims $25 million.
Under the agreement, Pfizer will be required to pay $10 million to the plaintiffs’ lawyers in a settlement.
In April, a federal court in New York ordered Merck to pay $250 million to settle an agreement that caused similar allegations to the New York State Department of Justice.
The plaintiffs’ lawyers were not immediately available Tuesday evening, but the company said in a statement that the settlement amount will not include any amount.
“It is our hope that the settlement agreement will help protect the integrity of Pfizer’s business and will improve the financial integrity of the company,” said Robert F. Zirkelstein, president and chief executive of Merck.
A spokeswoman for the company declined to comment.
